Terms and Conditions of Havi.fi
Havi.fi online store is an online store maintained by Havi Oy (0648171-4). These terms of agreement (later referred to as the “Terms”) apply to the sale of products purchased through the havi.fi online store between Havi Oy and its customers. We encourage you to read these Terms before placing an order in the havi.fi online store.
By ordering products from the havi.fi online store, the customer confirms that they have read these Terms, accepted them and agrees to act according to them. These Terms apply to all user activities on the havi.fi website.
Shopping and Registration in the Online Store
To order from the havi.fi online store, the customer must be over 18 years old and have a valid email address and postal address in Finland.
The customer can shop in the online store without registering as an user. For the purpose of delivering the order and the documents related to the order, the customer must provide their contact information when placing the order, which includes at least their name, address, telephone number and email address. The customer is responsible for the accuracy of the information they have provided and is obliged to notify Havi Oy of any changes to the information, if necessary.
Customer Information and Data Protection
Havi Oy processes personal data obtained through the online store and provided by the customer in a manner permitted and required by the current personal data legislation. Customer information is stored in a customer register maintained by Havi Oy.
Cookies
The Havi.fi website may use cookies or other similar technologies to use the online store website or to collect information related to the user's terminal device, such as information about when and which sections of the online store the user has browsed, what browser the user is using or which page the user has arrived from, in order to improve and analyze the online store and customer service. A cookie is a short text file that the web server stores on the user's terminal device via a web service. The information obtained using cookies is anonymous in nature, but it is possible to link the information obtained using cookies to personal data obtained from the user.
Cookies allow Havi Oy to monitor the number of users of the online store and other information related to its use, and to use the information obtained to analyze and develop its service to make it even more customer-friendly and to offer its customers targeted product recommendations, offers and benefits in the online store. If the user wishes, they can prevent the use of cookies in their browser settings or by deleting cookies from their browser after using the service. For more information on browser-specific instructions, see the browser manufacturer's instructions. However, deleting cookies or preventing their use may adversely affect the use of the service or certain of its functions or even prevent it.
Ordering
When ordering, a binding sales contract is created when the customer has sent their order to the online store. The customer is advised to check the content of their order carefully before confirming the order. Havi Oy will send the customer an order confirmation by email using the contact information provided by the customer. Havi Oy reserves the right not to accept the order. The customer must check that the content of the confirmation corresponds to the order placed by the customer.
Product Prices
The prices in the Havi.fi online store are in euros (EUR) and include VAT (25.5 %). Product prices do not include delivery costs, but they are stated separately when ordering and in the order confirmation.
The price of the product is the price displayed on the havi.fi online store page in connection with the product information at the time of ordering. The prices are valid until further notice or for a separately stated period. The prices of the products and deliveries in the online store are updated at regularly. Havi Oy reserves the right to correct and revise prices due to technical or human errors. If incorrect price information has been provided in the online store, and the error is so clear that the customer should have understood that it was an error (e.g. the price is exceptionally low compared to the actual price or the general price level), Havi Oy is not obliged to sell the product at the incorrect price.
Delivery
Havi Oy delivers the products it sells to the customer based on a transport contract it has made with a third party. Delivery of orders is possible in mainland Finland to addresses with a fixed road connection. Delivery costs are added to the order price. The delivery costs for each order can be seen in the online store's shopping cart. If an order includes multiple products, Havi Oy will charge the delivery cost according to the delivery cost of the most expensive product in the shopping cart.
The delivery time for products in stock is 3–8 business days from the the day of the order, depending on the delivery method. Delivery times are estimates. If the delivery of the order is delayed from the stated date, Havi Oy will notify the customer of the delay using the contact information provided by the customer and to provide the customer with a new estimate of the delivery time.
If necessary, the order can be divided into several shipments. If the order is delivered in several parcels, Havi Oy will charge delivery costs for only one parcel. Havi Oy reserves the right not to deliver the order if the product or its replacement product is no longer available. In such cases, the transaction is considered to be cancelled, and Havi Oy will return the payments received to the customer, excluding any delivery costs of the order. In such cases, Havi Oy will contact the customer and agree on proceedings. Havi Oy is not responsible if the delivery of the order is delayed or the order cannot be delivered for reasons regarding the customer, such as because the customer has provided incorrect contact information or has neglected to notify a change in their contact information.
Product Inspection and Complaints
When receiving an order, the customer must check right away that the delivered products are free of defects and that the delivery has included all of the products ordered. If the customer notices that there is a defect in the delivered product or that the order is otherwise incorrect, the customer must notify Havi Oy's customer service immediately or no later than 14 days after receiving the delivery.
Payment Methods
Products and their delivery costs are paid for when ordering. The payment intermediary service and payment service provider is Paytrail Oyj (2122839-7) in cooperation with Finnish banks and credit institutions. When ordering from the havi.fi online store, the payment transaction is made through the payment service managed by Paytrail Oy. Havi Oy is responsible for the products, their delivery and customer service, as well as complaints. The following payment methods can be used in the online store: Nordea, Osuuspankki, Danske Bank, Tapiola, Aktia, Nooa, Paikallisosuuspankit, Säästöpankit, Handelsbanken, S-Pankki, Ålandsbanken and Visa, Visa Electron, MasterCard cards.
Cancellation and Returns
The customer of the Havi.fi online store can cancel the purchase and return the product purchased from the online store within 14 days of receiving the delivery by notifying Havi Oy. However, the customer does not have the right to cancel after opening the packaging for hygiene products, because the product cannot be put up for resale. Hygiene products include, for example, soaps and room diffusers. To return the product, the customer must fill out the return form that came with the package. Detailed instructions for making a return can be found at www.havi.fi/palautus. The customer must return the canceled product to Havi Oy without delay and no later than 14 days after submitting the cancellation notification. Under normal circumstances, Havi Oy is responsible for the postage costs of canceled products. However, if the product cannot be returned by regular mail, for example due to its large size or weight, the customer is responsible for the return costs of the product. Failure to pick up the product from the delivery location when the customer has not made an explicit cancellation notification is considered a cancellation of the product. Havi Oy will not refund any delivery costs of the original order to the customer. Havi Oy will refund the value of the returned products using the payment method used by the customer. Havi Oy will refund the payments it has received without delay and no later than 14 days after receiving the customer's cancellation notice. Havi Oy has the right to withhold the refund until Havi Oy has received the product back or until the customer has proven that they have sent the product back.
Once the customer has received the product, they must keep it essentially unchanged until they have decided to keep the goods. If the returned product has been used in violation of the buyer's statutory duty of care, Havi Oy has the right to charge the reduction in value up to the full price of the product.
Force Majeure
The Havi.fi online store complies with its obligations under the terms and conditions to the extent that it can reasonably be required to do so. However, Havi.fi is not responsible for any possible product defects, delays or other breaches of contract that are due to circumstances beyond its control (force majeure). Force majeure includes, for example, industrial action, staff illness, import and export bans and possible disruptions in transport. In the event of a delay, the havi.fi online store will, however, strive to serve the customer in the best possible way and comply with its obligations as soon as possible under the circumstances.
Terms and Conditions Coming into Effect
These terms and conditions came into effect on October 1st 2024 and are valid until further notice. These terms and conditions apply to orders placed after the terms coming into effect.
Applicable Law and Dispute Resolution
The Havi.fi online store and these Terms are governed by Finnish law, excluding its choice of law regulations. The parties shall primarily seek to resolve disputes through negotiation. If an amicable settlement cannot be reached, the disputes shall be resolved in the Helsinki District Court in Finland. The consumer may also submit the matter to the Consumer Disputes Board (www.kuluttajariita.fi). Before submitting the matter to the Consumer Disputes Board, the consumer must contact the Consumer Advice Service of the local register office (www.kuluttajaneuvonta.fi). The consumer-customer may also submit the dispute to the competent district court determined according to their place of residence.
